Which regulations apply to Canadian fintechs?

Fintech compliance in Canada depends on what you do rather than what you call yourself. Payment service providers fall under the Retail Payment Activities Act and are supervised by the Bank of Canada, which since September 8, 2025 has required registered PSPs to maintain operational risk management and incident response frameworks, safeguard end-user funds, and file an annual report. Businesses dealing in money transfer or currency exchange register with FINTRAC as money services businesses and carry obligations under the PCMLTFA. Customer data falls under PIPEDA, and card data under PCI DSS.
